These Terms of Service & Repair Agreement ("Terms") apply to goods and services supplied by Blue's Computer Repairs ("we", "us" or "our") to the customer ("you" or "your").

By accepting a quote, approving a work order, authorising work, purchasing goods or otherwise engaging us to provide goods or services after being provided access to these Terms, you agree to these Terms.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law ("ACL") or other applicable legislation.

1. DIAGNOSTICS

1.1 Diagnostic Services

Where a diagnostic inspection is requested or reasonably required, we may inspect, test, disassemble and operate equipment to the extent reasonably necessary to identify reported or apparent faults.

1.2 Diagnostic Findings

Diagnostic findings are based on the symptoms, condition of the equipment and information reasonably available to our technician at the time.

Some faults may be intermittent, concealed, related to multiple components or only become apparent after another fault has been repaired.

A diagnostic finding therefore does not guarantee that every existing or future fault has been identified.

1.3 Diagnostic Fees

Any agreed diagnostic or inspection fee remains payable where the diagnostic service has been properly performed, whether or not you proceed with a recommended repair.

This does not affect your rights under the Australian Consumer Law.

1.4 Additional Faults

Where additional faults or required repairs become apparent, we will seek your approval before undertaking additional chargeable work outside the agreed scope unless you have previously authorised us to proceed up to an agreed spending limit.

2. QUOTES & ESTIMATES

2.1 Quotes

Quotes are based on the information, symptoms and condition reasonably known at the time they are issued.

Unless otherwise stated, a quote does not include additional faults, parts or services that could not reasonably have been identified before work commenced.

2.2 Additional Work

We will seek your approval before undertaking additional chargeable work that would materially increase the agreed price.

2.3 Quote Validity

Unless otherwise specified, quotes are valid for 30 days from the date of issue.

Supplier pricing and availability may change after the quote expires.

3. REPAIR AUTHORISATION

By authorising diagnostic or repair work, you authorise Blue's Computer Repairs, where reasonably necessary, to:

  • inspect and diagnose the equipment;

  • open or disassemble the equipment;

  • power the equipment on and off;

  • connect diagnostic equipment;

  • access operating systems and device settings;

  • connect the equipment to a network or the internet;

  • install or run diagnostic and testing software;

  • remove and replace authorised components;

  • perform reasonable pre-repair and post-repair testing; and

  • access information stored on the equipment only to the extent reasonably necessary to diagnose, repair or test it.

Blue's Computer Repairs will exercise reasonable care and skill when undertaking these activities.

4. CUSTOMER DATA & BACKUPS

4.1 Customer Backups

Devices presented for repair may contain important or irreplaceable data.

You should maintain a current backup of important data before supplying equipment to us wherever reasonably possible.

Blue's Computer Repairs may provide backup or data-transfer services where available for an additional quoted charge.

4.2 Risk of Data Loss

Diagnostic, repair, software, recovery and testing procedures may involve a risk of data corruption, alteration or loss.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including rights arising under the Australian Consumer Law.

4.3 Access to Customer Data

Our technicians will only intentionally access personal files or information where reasonably necessary to diagnose, repair, test or provide an authorised service.

We will take reasonable steps to protect the confidentiality of information encountered while providing our services.

4.4 Passwords & Access Codes

Where you provide a password, PIN or other access credential, you authorise Blue's Computer Repairs to use it only as reasonably necessary to perform the authorised service.

We recommend changing passwords or access credentials disclosed to us after completion of the repair.

5. REPAIR NOTICE — USER-GENERATED DATA

Where goods presented for repair are capable of storing user-generated data, Blue's Computer Repairs will provide any repair notice required by applicable law before accepting the goods for repair.

IMPORTANT: Repairing your goods may result in the loss of user-generated data. Customers should back up important data wherever reasonably possible before equipment is presented for repair.

Where applicable, additional notice concerning the potential use of refurbished goods or refurbished parts will also be provided.

6. PARTS & HARDWARE

6.1 Parts Supplied by Blue's Computer Repairs

Replacement parts supplied by Blue's Computer Repairs may be new, refurbished or used where this has been disclosed and agreed with you.

6.2 Customer-Supplied Parts

Where you request that we install a part supplied by you, Blue's Computer Repairs does not provide a voluntary warranty against defects for the customer-supplied part itself.

We cannot guarantee the compatibility, quality, reliability or remaining service life of a customer-supplied part.

Our obligations regarding the workmanship we provide remain unaffected.

If a customer-supplied part proves defective or incompatible and additional labour is required, additional labour charges may apply with your approval.

7. 28-DAY VOLUNTARY REPAIR WARRANTY

7.1 Warranty Period

Unless otherwise stated in writing, Blue's Computer Repairs provides a 28-day voluntary repair warranty on eligible repair parts supplied by us and workmanship associated with the relevant repair.

The 28-day period begins on the date the repaired equipment is returned to you or made available for collection.

7.2 What the Voluntary Warranty Covers

Where an eligible fault covered by our voluntary warranty occurs within the 28-day warranty period, please contact us as soon as reasonably practicable.

We will inspect the equipment and, where the fault is covered by our voluntary warranty, rectify the covered workmanship or replace or rectify the covered part as appropriate without charging you for the covered rectification.

Please provide reasonable evidence of the original transaction, such as an invoice, receipt or other proof of purchase, together with a description of the issue.

7.4 Warranty-Related Expenses

Please contact Blue's Computer Repairs before incurring freight, courier or other expenses in connection with a voluntary warranty claim.

Responsibility for reasonable claim-related expenses will be determined according to the circumstances and applicable law.

Nothing in these Terms requires a customer to bear an expense that Blue's Computer Repairs is legally required to bear.

7.5 Voluntary Warranty Exclusions

To the extent permitted by law, our 28-day voluntary warranty does not cover a new or unrelated fault caused by:

  • accidental or physical damage occurring after repair;

  • subsequent liquid or moisture damage;

  • misuse, abuse or neglect;

  • electrical surge or external power faults;

  • malware or subsequent software problems;

  • unauthorised modification;

  • subsequent repairs or alterations performed by another person;

  • customer-supplied parts;

  • normal wear and tear; or

  • faults unrelated to the original repair.

These exclusions apply to our voluntary warranty only and do not exclude or restrict rights that cannot lawfully be excluded.

7.6 Australian Consumer Law

The 28-day voluntary repair warranty is an additional benefit provided by Blue's Computer Repairs.

Expiry of the 28-day voluntary warranty does not mean that your rights under the Australian Consumer Law have expired.

Your statutory rights may continue beyond the voluntary warranty period.

Australian Consumer Law Statement — Goods and Services

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  • to cancel your service contract with us; and

  • to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to choose a refund or replacement for major failures with goods.

If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion.

You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

8. REFUNDS & RETURNS

8.1 Change of Mind

Blue's Computer Repairs is not required to provide a refund or exchange where you simply change your mind.

We may choose to accept a change-of-mind return at our discretion.

8.2 Faulty Goods or Services

Our change-of-mind policy does not affect your rights under the Australian Consumer Law.

Where goods or services fail to satisfy an applicable consumer guarantee, you may be entitled to a repair, replacement, refund, cancellation, compensation or another remedy depending on the circumstances.

8.3 Consumables

We generally do not accept change-of-mind returns for opened or used consumable products.

This does not affect your rights where a product fails to comply with an applicable consumer guarantee.

8.4 Purchase Discrepancies

Please notify us as soon as reasonably practicable if an order appears incorrect, incomplete or damaged.

Prompt notification assists us in investigating the issue but does not limit statutory rights or remedies.

9. DEPOSITS & ORDERED PARTS

9.1 Parts Deposit

Where parts are required to be ordered to complete an authorised repair or service, a deposit equal to the full quoted cost of all parts required to be ordered is payable before those parts will be ordered, unless otherwise agreed in writing.

Once a quote has been accepted, Blue's Computer Repairs will issue a separate deposit invoice for the applicable parts deposit.

Parts will not be ordered until the deposit invoice has been paid in full.

The deposit relates to the cost of the required ordered parts only. Labour and any remaining charges will be payable upon completion or delivery unless otherwise agreed in writing.

9.2 Cancellation After Parts Have Been Ordered

Where parts have been specifically ordered for your repair or service and you subsequently cancel the work, Blue's Computer Repairs may retain or recover reasonable costs actually incurred as a result of ordering those parts, where permitted by law.

Where an ordered part can reasonably be cancelled or returned to the supplier and Blue's Computer Repairs receives a refund, any amount of your deposit not required to cover reasonable costs actually incurred will be refunded to you.

Reasonable costs may include non-refundable supplier charges, freight, return freight, restocking fees or other costs actually incurred, where permitted by law.

Nothing in this section limits any rights or remedies available under the Australian Consumer Law.

9.3 Unable to Supply

If Blue's Computer Repairs is unable to obtain an ordered part or provide the agreed service, we will discuss available alternatives with you.

Where the agreed part or service cannot be supplied, any applicable refund or other remedy will be provided in accordance with the Australian Consumer Law and other applicable law.

10. PAYMENT

Unless otherwise agreed in writing, payment is due upon completion or delivery of the goods or services.

Blue's Computer Repairs accepts:

  • cash;

  • EFTPOS;

  • bank transfer; and

  • PayID.

Where permitted by law, equipment may be retained until amounts properly due and payable for authorised work have been paid.

For electronic payments, customers should use the relevant quote or invoice number as the payment reference wherever possible.

11. PRE-EXISTING DAMAGE & CONDITIONS

Equipment may contain pre-existing faults, deterioration or damage including:

  • cracked or damaged housings;

  • corrosion;

  • liquid damage;

  • missing screws or components;

  • damaged connectors;

  • degraded batteries;

  • previous repair attempts;

  • modified hardware or software; or

  • components approaching the end of their service life.

Where reasonably practicable, significant pre-existing conditions identified by us may be recorded.

Blue's Computer Repairs is not responsible for pre-existing damage or unrelated faults merely because they become apparent during or following our work.

Nothing in this section excludes liability for damage caused by our failure to exercise due care and skill or otherwise limits rights that cannot lawfully be excluded.

12. SEVERELY DAMAGED EQUIPMENT

Equipment affected by significant physical damage, liquid ingress, corrosion, electrical damage or previous unsuccessful repairs may deteriorate or fail during ordinary diagnostic or repair procedures.

We will exercise reasonable care and skill when handling such equipment.

We cannot guarantee that severely damaged equipment will remain operational or repairable.

Nothing in this section excludes liability that cannot lawfully be excluded.

13. SOFTWARE, MALWARE & OPERATING SYSTEMS

Customers are responsible for maintaining valid licences for software installed on their equipment unless the licence is supplied as part of our service.

Malware removal and software repair cannot guarantee that a system will never subsequently become infected or experience another software fault.

Where a clean installation, factory reset or other procedure affecting stored data is reasonably necessary, we will seek appropriate authorisation before proceeding where practicable.

14. PRIVACY & CONFIDENTIALITY

Blue's Computer Repairs will take reasonable steps to protect personal information and customer data in our possession.

We will not intentionally access, copy, disclose or use personal information stored on customer equipment except:

  • where reasonably necessary to provide the authorised service;

  • with the customer's consent;

  • where reasonably necessary to protect legitimate legal interests; or

  • where required or authorised by law.

We will not disclose customer information to another person merely because that person claims to represent the customer.

We may request reasonable evidence of authority before discussing an account, repair or customer information with a third party.

15. COLLECTION OF EQUIPMENT

We will make reasonable attempts to notify you when equipment is ready for collection or where further instructions are required.

You are responsible for providing accurate and current contact information.

Unless otherwise agreed, equipment should be collected within 30 days after notification that it is ready for collection.

We may contact you using the contact information you have provided to remind you that your equipment remains ready for collection.

16. UNCOLLECTED GOODS

Customer equipment does not automatically become the property of Blue's Computer Repairs because it remains uncollected.

Where equipment remains uncollected, Blue's Computer Repairs may take steps to deal with the equipment in accordance with the Disposal of Uncollected Goods Act 1970 (WA) and any other applicable Western Australian law.

This may include providing required notices and observing applicable waiting periods before goods can lawfully be sold or otherwise disposed of.

Any sale, disposal, application of proceeds and records relating to uncollected goods will be handled in accordance with applicable law.

17. COURIER, FREIGHT & TRANSPORT

Where delivery, courier or freight services are requested, applicable charges will be disclosed or agreed with you.

Responsibility for warranty-related transport costs will be determined in accordance with applicable law and the circumstances of the claim.

Nothing in this section requires a customer to pay a cost that Blue's Computer Repairs is legally required to bear.

18. LIMITATION OF LIABILITY

Nothing in these Terms excludes, restricts or modifies a right, consumer guarantee, remedy or liability that cannot lawfully be excluded, restricted or modified.

To the extent permitted by law, Blue's Computer Repairs is not responsible for loss or damage caused by circumstances outside our reasonable control or faults, damage or losses not caused by our goods or services.

Any limitation contained in these Terms applies only to the extent permitted by law.

19. CUSTOMER RESPONSIBILITIES

Customers are responsible for:

  • providing accurate information concerning equipment and reported faults;

  • advising us of known liquid damage, previous repairs or significant faults;

  • maintaining backups wherever reasonably possible;

  • providing lawful access to equipment where required;

  • ensuring they have authority to authorise work on equipment;

  • responding to requests for approval or instructions within a reasonable time; and

  • paying amounts properly due for authorised goods and services.

20. OWNERSHIP & AUTHORITY

By supplying equipment to Blue's Computer Repairs, you confirm that you own the equipment or have lawful authority from the owner to authorise the requested services.

We reserve the right to decline work where we reasonably believe a person does not have authority to possess or authorise work on the equipment.

21. REFUSAL OF SERVICE

Blue's Computer Repairs may reasonably decline or discontinue work where:

  • equipment presents a safety risk;

  • requested work would be unlawful;

  • the customer does not have authority over the equipment;

  • required parts or services are unavailable;

  • the requested repair is not reasonably practicable; or

  • threatening, abusive or unsafe conduct occurs.

Reasonable charges for authorised work already performed may remain payable, subject to applicable law.

22. CHANGES TO THESE TERMS

Blue's Computer Repairs may update these Terms from time to time.

The version applicable to a transaction will generally be the version provided or made available when the quote, work order or service was accepted.

Updated Terms will not retrospectively alter an existing agreement unless agreed by the parties or otherwise permitted by law.

23. GOVERNING LAW

These Terms are governed by the laws applicable in Western Australia and the Commonwealth of Australia.
